The personal injury claim process
Dealing with insurance companies for a salary or position can be a challenging experience, but learning how to negotiate for a bodily injury claim can be daunting. The methods of an insurance company in handling a bodily injury claim can be a cold and calculating process on the Insurance Companys' part. The staff at Superior Law understands this process and can help shed light on this potentially intimidating process.
An insurance company's bottom line is to make money. Their goal is to get a claim settled quickly to fulfill their obligation to their insured and save money for the accident. When your personal injury claim is handled by Superior Law, we immediately gather all the information, including police reports, witness statements, photographs, and any other investigative material that is relevant to your claim. To attain a full scope of your injuries, medical reports are attained (these are records which are kept by doctors, hospitals, and other providers keeping track of the medical treatment), medical bills, salary information, and letters by your treating physicians to obtain a thorough understanding of your injury. This process can take a couple of months to in excess of a year, depending on the severity of the injuries. Through the process, however, we maintain contact with you on a regular basis so we maintain an understanding of your injury from start to finish.
Once your injuries have fully healed or are at least stable with a clear understanding of the future of the injury, a complete and comprehensive evaluation of your claim is completed including who is at fault as well as an amount of money damage analysis. We will share with you the strengths as well as the weaknesses of your claim. We will come to a mutual agreement of an acceptable settlement range of your claim. Once the range of settlement is set, the negotiation process with the insurance carrier will begin.
The professional staff at Superior Law are aggressive fighters and seasoned negotiators within the specialized focus of settling bodily injury claims for the most money. We not only have that perspective from the client's standpoint, we also have, a very thorough understanding from the insurance carrier's perspective as Jeff Wehe, our claim manager was a former senior claim representative and claim supervisor for a national insurance company for over 12 years. Our contact with the insurance company is not only during the settlement process. It is our objective to maintain and open dialog with the insurance adjuster keeping him up to date with medical and investigative report's so that they may maintain adequate loss reserves (money set aside to settle your claim). We find that wherever possible, this cooperative approach with the insurance carrier at first lends itself to a much more efficient and affective claims process.
If we cannot settle the case out of Court for you, we will take the case to Court for you.
Once a settlement has been agreed upon, a document will be signed releasing both the insurance company and their insured from further action. Once a release is signed, no further action can be taken against the responsible party. In the event that a settlement can not be reached within the settlement range the option of litigation exists.
In summary, the professional staff at Superior Law are trained, experienced, and well equipped to handle and negotiate a personal injury claim that best suits the client's needs.
